TWiT Sues Twitter After Falling Way Past Rock Bottom

When Leo Laporte showed his inbox Sunday, we wondered what a message from his lawyer stating “We will file the complaint Tuesday since the courts are closed on Monday” was about.

We started searching the Northern District of California Courts and the federal PACER system, but we found nothing.

Unfortunately, TechCrunch scouped us.

TWiT sued Twitter for trademark infringement.

The chat room was/is muted for hours, of course. Ycombinator discussions are happening — including saying TD is “made by a hateful obsessive” and “run by an ex-employee”.

Leo Laporte is alleging that some reasonable person would confuse Twitter for TWiT’s useless trademarks. Nobody knows what TWiT is!

As one Total Drama chat room member put it:

“One shows NFL games, one shows a fat man’s stubby pecker

Leo’s lawyers wrote, without irony:

“The TWIT mark is a strong, distinctive mark, in which substantial goodwill has developed to the benefit of plaintiffs Laporte and TWiT.”

Wow.

Leo — probably Lisa — wants a settlement. That’s how desperate they are for money. They even enabled monetization on their YouTube videos recently. They want that Twitter money to keep going on cruises since their actual business is toast.

        Nobody wants to buy TWiT because the network isn’t sustainable post-Leo. This isn’t CNN or FOX, once he goes TWiT ceases to exist.

        He and Lisa are praying for a settlement, and they might get it depending on Twitter’s desire to fight this. If you’ve watched TWiT over the past 18-24 months you know that Leo doesn’t give a damn, that he’s more concerned about his next vacation than producing a worthwhile show.

        The problem is he’s locked into a lease on the Shithole Studios that runs $9k/month. When I first read about this lawsuit I figured Leo would be shooting for the moon. My guess is he’d settle for mid to low 7 figures, enough to write off the lease and retire comfortably while doing a show a day from his home.

        My, how the mighty have fallen. The real shame of it all is that the Brickhouse Studios never got turned into a pub. That building gave TWiT an aura of legitimacy. Now it’s a sad joke.

          This is about the lease. He constantly laments the fact that they’re locked into the Shithole Studios. With Padre leaving for the Vatican and his or Lisa’s inability to attract mid to high level talent, the network is beginning to show cracks.

          He doesn’t need a studio if it’s just him and guests via Skype. $108k/year on the lease, employee salaries, miscellaneous costs. If he worked from home, had Lisa do the books, and kept along 1 idiot engineer he’d pocket 8 figures annually.

          We’ve all joked for years about the end being nigh for TWiT. This lawsuit is the deathknell. He either wins and rides off into the sunset, dabbling in tech on his own time, or Twitter wins and things get really nasty.

      Leo STOLED the name from Tucson Western International Telethon (aka TWIT) who was using it 20 years before Leo did!! If anyone should sue for diluting and stealing a name, it should be Tucson Western suing Leo!! Leo’s venture into video has totally and completely confused the public on whether “TWIT” means either Leo’s stuff or Tucson Western International’s content. Wonder if any “prior use” argument can be made that nullifies Leo’s legal “ownership” of that word/acronym. I also have always wondered if the small letter I in TW i T means something in legalese.

      Before Lisa took control, Leo wanted to build a presence on the East Coast (maybe could have partnered with GFQ)…With modern technology many of the shows could be done from home studios, etc, and the cottage could have been adequate going forward..

  12. This is bad for journalism in any case. One of the important things about Twitters nature is that is a really significant web service which is also questionable from a business perspective.
    The ability for TWiT to offer any serious commentary or reporting on the state of a service like that given they have open interpersonal and legal issues with it is really questionable, and then that could spread to questions about objectivity in reporting on TWiT’s competition, which includes names such as Google and Facebook.
    That said, TWiT’s quality level has fallen to such a low level no one will probably care about an issue like this anymore.

      I don’t think you understand trademark law, because it doesn’t work that way.

      But Leo will lose. Often, the lawyers have a fee agreement. Leo will pay 5K and they’ll file the case and if the lawyers want to take the case farther based on Twitter response they will do it on their own dime but get 50% of proceeds. The big companies face a lot of little claims, mostly class action, and basically dole out cash based on merit of claim. Vast majority get nothing and give up. Very few make an impact or get to the papers/trades. Leo’s case should not have been picked up by media, that story was an ignorant and friendly journalist. Probably has been on twit before.

He knew that he needed to keep working on SQRL so he decided that he would wait for someone else to write a utility that could provide all the information that most people don’t understand wrt the Spectre problem in an executable that is less than 125KB. Twenty four hours later, NO ONE HAD DONE SO which sadly for us meant that Steve needed to drop SQRL to write InSpectre.

            Interesting how so many of these alleged “superstar tech babes” (Belmont, Lane, etc.) sort of fizzled out over the years…moving up to supposedly high profile jobs, only to bounce around, never staying in one place too long and never making it big.

            Veronica Belmont seems to have moved behind the scenes. I’m not sure what her husband is up to, but I think he makes enough money that she’s allowed to indulge in the typical SF/Silicon Valley startup BS.

            Belmont, and I hate to say this, is a dime a dozen. Every 6 months a new ditzy tech obsessed woman pops up that everyone goes crazy about. One year it’s Veronica, the next iJustine, then Naomi Kyle.

        True. We’re keeping an eye on the lawsuit though. Many documents going back and forth. It doesn’t look like they’re settling, so far. Twitter has 3 lawyers officially on the case in the court documents.
